Age Discrimination

The Age Descrimination in Employment Act of 1967 is a federal law which prohibits the discrimination against employees of age 40 or more by any employer in the United States. A worker's age or job applicant's age can have no bearing on any term, privilege or condition of employment at any company with twenty or more employees including hiring, firing, layoff, compensation, promotion, benefits, training, and job assignments. It is not lawful to retaliate against any individual who opposes age discrimination, reports suspected age discrimination, participates in an investigation or testifies in a hearing related to age discrimination. The law does allow employers to favor an older employee based on age even if doing so adversely affects a younger worker over the age of 40. The Older Workers Benefit Protection Act passed in 1990 specifically prohibits employers from denying any benefits to older employees.
