Premise Liability

Premise liability is the concept that the owner of a property is responsible for injuries incurred to people present on the property. The injuries can include falls into excavation holes, uneven pavement, wet slippery flooring, crumbling curbs or sidewalks, standing water, loose throw rugs, inadequate lighting and icy walkways. There may also be blunt force injuries caused by falling objects or defective seating and crowd related injuries due to inadequate security or crowd control. The defendant in question must own or hold a licensure for the use of the premesis on which the injury occured and the plaintiff in most states must be on the premesis legally as opposed to being there in the form of a trespasser. There must also be some form of negligence or wrongful act present to cause the injury.
